Terms and Conditions of Service
By scheduling service with Peak Flame, LLC ("Peak Flame"), the customer agrees to the following Terms and Conditions.
Scope of Services
Peak Flame provides gas fireplace inspection, maintenance, diagnostic, repair, cleaning, and related services for existing gas fireplace systems. Peak Flame does not perform structural modifications, chimney repairs, gas line installations requiring permits, electrical work, masonry work, or manufacturer warranty work unless specifically agreed to in writing.
Any installation work requiring licensed subcontractors may be performed by independent third-party contractors. Peak Flame is not responsible for the actions, workmanship, warranties, scheduling, or performance of third-party contractors.
No Guarantee of Repair
While Peak Flame makes every reasonable effort to diagnose and repair fireplace systems, no guarantee is made that any particular repair will restore the unit to full operation.
Many fireplaces contain discontinued, obsolete, unavailable, or manufacturer-specific components. In some cases, replacement parts may not be available, and complete replacement of the appliance may be recommended.
Diagnostic fees, service fees, labor charges, and trip charges are non-refundable regardless of whether a repair is completed or successful.
Access to Equipment
The customer shall provide safe, unobstructed access to the fireplace, controls, venting system, electrical outlets, and related components.

If access is restricted or unsafe, Peak Flame may suspend or terminate service and charge applicable trip, diagnostic, or rescheduling fees.
Existing Conditions and Hidden Defects
Gas fireplaces often contain concealed conditions that may not be visible until service begins. Peak Flame shall not be responsible for pre-existing defects, hidden damage, corrosion, deterioration, improper installation, code violations, water intrusion, venting defects, rodent damage, or manufacturer defects discovered during service.
The customer acknowledges that disassembly of aging equipment may reveal previously unknown defects requiring additional repairs.
Safety Recommendations
Peak Flame reserves the right to declare a fireplace unsafe for operation.
If an unsafe condition is identified, Peak Flame may recommend that the appliance remain shut down until repairs or replacement are completed.
Peak Flame shall not be liable for damages, injury, property loss, carbon monoxide exposure, fire, or equipment failure resulting from a customer's decision to operate a fireplace after being advised of a safety concern.
Customer-Supplied Parts
Peak Flame does not warranty customer-supplied parts.
Labor performed to install customer-supplied parts is billed at standard rates and carries no guarantee regarding the compatibility, quality, performance, or longevity of those parts.
Additional labor required due to defective or incorrect customer-supplied parts shall be billed separately.
Estimates
All estimates are based upon conditions visible at the time of inspection.
Additional labor, materials, repairs, or services required due to concealed conditions, additional defects, or unforeseen circumstances may result in additional charges.
No estimate shall be considered a fixed-price contract unless expressly stated in writing.
Warranty
Parts supplied and installed by Peak Flame are covered by a one (1) year limited warranty against defects in materials.
Labor performed by Peak Flame is covered by a fifteen (15) day workmanship warranty.
Warranty coverage excludes:
Peak Flame reserves the right to inspect any claimed warranty issue before determining coverage.
Warranty liability is limited solely to repair or replacement of the original covered work.
Limitation of Liability
To the fullest extent permitted by law, Peak Flame's total liability for any claim arising out of services performed shall not exceed the amount paid by the customer for the specific service giving rise to the claim.
Under no circumstances shall Peak Flame be liable for indirect, incidental, consequential, punitive, or special damages, including loss of use, loss of enjoyment, property damage, business interruption, lodging expenses, or personal injury resulting from fireplace operation or failure.
Payment Terms
Payment is due immediately upon completion of service unless otherwise agreed in writing.
Accepted payment methods include cash, check, ACH, and credit/debit card.
A 3% convenience fee applies to credit and debit card transactions.
Accounts not paid within three (3) business days of service completion may be assessed a late fee equal to ten percent (10%) of the outstanding balance.
The customer shall be responsible for all collection costs, attorney's fees, court costs, and expenses incurred in recovering unpaid balances.
Returned checks are subject to a $35 returned payment fee.
Deposits and Special Order Parts
A non-refundable deposit equal to thirty percent (30%) of the quoted amount may be required for special-order parts or custom materials.
Once parts have been ordered, deposits are non-refundable.
Special-order electrical components, gas valves, control modules, circuit boards, glass assemblies, and discontinued parts may not be eligible for return.
Appointment Cancellations
Appointments canceled or rescheduled with less than twenty-four (24) hours notice are subject to a $50 cancellation fee.
Appointments canceled on the day of service are subject to a $50 cancellation fee.
If multiple fireplaces are scheduled and one or more units are removed from the work order on the day of service, a $50 cancellation fee may apply per removed unit.
Customers who are unavailable during the scheduled arrival window may be charged a trip fee and required to reschedule.
Multi-Sided Fireplaces
Multi-sided fireplaces require additional labor and handling.
An additional fee of $25 shall apply for each additional pane of glass beyond the first.
Photography and Documentation
Peak Flame may photograph fireplace components, defects, venting systems, and completed work for documentation, warranty, training, insurance, and recordkeeping purposes.
No personally identifiable customer information will be publicly disclosed without permission.
Governing Law
These Terms and Conditions shall be governed by the laws of the Commonwealth of Virginia.
Any dispute arising from services provided by Peak Flame shall be resolved in the courts of the Commonwealth of Virginia.
Acceptance
Scheduling service, signing an estimate, approving a repair, or allowing work to commence constitutes acceptance of these Terms and Conditions.
